It’s been three years since the Dobbs decision and the overturning of Roe v Wade. In that time, the fight for reproductive freedom has moved beyond the courts, into our devices, our data, and our daily lives. 

Today, across the US and beyond, many women and people with cycles live with the fear that their personal health information – data that should be empowering, insightful, even life-saving – could be used against them. 

In this complex landscape, where science and medicine are often sidelined by politics, we stand firm in our commitment: 

We will always protect your data. And we are prepared to defend and protect that promise at all costs. If we are subpoenaed by any authority demanding access to your data, we will not comply.

As an independent company based in Berlin, Germany, we have a primary legal duty under European and German law not to disclose private health data. No authority can override that. We will fight any attempt to do so, publicly and relentlessly. 

We have looked into this deeply and concluded that applicable legal privacy and due process protections ultimately justify a refusal of any request for disclosure of personal health data. 

We firmly believe that as women and people with cycles, our private health data must serve us and never be used against us. Our app exists to serve you, our community – not the agendas of advertisers, insurance companies, data brokers, or anyone else.

Our commitment is not new. It has been at the core of Clue’s values for over a decade. And it’s not bound by geography, but by principle. 

Because ignorance about our health and our bodies has never protected us.

Because fear should not keep anyone from knowing and understanding their own body. 

Because health data is power. And privacy keeps that power in your hands. 

We refuse to accept a future where keeping a personal health record comes at the expense of privacy and bodily autonomy. And we will never be complicit in reproductive surveillance. 

We know what’s at stake. And we will always fight to protect your right to know your own body, on your terms.
